Inverse
Condemnation. A
legal procedure existing to obtain compensation when a
property interest has been taken or diminished in value,
specifically by a government activity.
For
instance, John owns a lake property near an airport. The
city adds an airstrip at the airport, and it causes air
traffic to fly directly over John's house. This will
lead to less enjoyment by John of his property. John may
sue for inverse condemnation and, if he succeeds, he may force
the airport authority to take his house in exchange for ample
compensation.
